Consent & Agreement
R.1.1 By participating in or collaborating with RotYounges on any project, you explicitly agree to the terms and conditions outlined by the company. These terms will be made available to you prior to your involvement in the project, and by continuing, you acknowledge that you have read and understood them.
R.1.2 If you do not agree with the terms, please refrain from participating in any RotYounges projects.
Art. 1. General Terms
1.1 RotYounges is a creative artistic production company, founded in 2023 in Prinsenbeek, the Netherlands, specializing in creating artistic stories and short films.
2.2 These terms and conditions apply to all services and activities provided by RotYounges, as well as to interactions between RotYounges and its employees, freelancers, and other parties involved in projects.
Art. 2. Behavior and Safety on Set
2.1 RotYounges enforces a strict zero tolerance policy for unsafe behavior on set.
2.2 All employees, volunteers, and participants in projects must behave professionally and contribute to a safe working environment.
2.3 In case of an unsafe situation, immediate contact must be made with one of the producers of RotYounges. The producers will take immediate action to ensure safety and resolve the situation.
Art. 3. Processing of Personal Data
3.1 RotYounges respects the privacy of its employees, clients, and other involved parties.
3.2 All personal data collected, both online and through personal contact, will be processed and stored with due care in compliance with applicable privacy laws (such as the General Data Protection Regulation - GDPR).
3.3 Personal data obtained via our website or other online channels will only be used for the purposes for which it was provided.
3.4 Data provided via direct contact will only be retained as long as necessary for the execution of the respective activity or agreement.
Art. 4. Careless Use of Personal Data
4.1 If it is found that RotYounges has mishandled personal data (e.g., loss or unauthorized access), RotYounges will make efforts to rectify the situation.
4.2 In the event of damage caused by careless use of personal data, RotYounges, if fault is established, will offer compensation in accordance with the decisions of the Dutch court in Breda, North Brabant.
Art. 5. Liability
5.1 RotYounges is not liable for any damage arising from force majeure, unforeseen circumstances, or actions by third parties beyond its control.
5.2 The liability of RotYounges is limited to the amount covered by its insurer in the specific case.
Art. 6. Intellectual Property
6.1 All products (scripts, films, creative works) produced by RotYounges are the property of RotYounges unless otherwise agreed.
6.2 It is prohibited to use the intellectual property rights associated with these works without permission from RotYounges.
Art. 7. Governing Law and Disputes
7.1 These terms are governed by Dutch law.
7.2 Disputes arising from cooperation with RotYounges will be resolved through mutual consultation.
7.3 If a solution cannot be reached, the dispute will be submitted to the competent court in Breda, North Brabant.
Art. 8. Amendments to the Terms
8.1 RotYounges reserves the right to amend these terms at any time.
8.2 Any changes will be communicated to the involved parties in writing or via email.
Art. 9. Payment Terms and Compensation
9.1 All payments for services provided by RotYounges must be made according to the agreed terms and deadlines.
9.2 If payments are not made on time, RotYounges reserves the right to charge statutory interest and/or suspend the execution of work.
9.3 Payments must be made to the designated account number and in the specified payment method.
Art. 10. Use of Materials and Media
10.1 RotYounges reserves the right to use images, videos, photos, and other materials created during the production of projects for promotional purposes, publicity, and marketing, both online and offline.
10.2 This may include the use of media on social media, websites, and other communication channels.
10.3 If this is not desired, it must be discussed with RotYounges in writing before production begins.
Art. 11. Confidentiality and Non-Disclosure
11.1 All parties involved in RotYounges projects (employees, freelancers, and other partners) agree to keep confidential information obtained during their work.
11.2 This includes information related to scripts, concepts, creative ideas, and other business-sensitive data.
11.3 Confidentiality remains in effect even after the collaboration ends.
Art. 12. Force Majeure
12.1 In the event of force majeure (natural disasters, illness, strikes, or other unforeseen circumstances that prevent the execution of RotYounges activities), RotYounges is not liable for delays or cancellations of planned services or productions.
12.2 In such cases, RotYounges will make efforts to minimize the impact on the involved parties.
Art. 13. Cancellations and Changes
13.1 If a participant in a project, freelancer, or another involved party is unable to fulfill their obligations, they must notify RotYounges as soon as possible.
13.2 RotYounges reserves the right to cancel a project, production, or service or make changes, provided this is communicated in writing in advance.
Art. 14. Health and Well-Being Information
14.1 Everyone involved in a production must be aware of and take responsibility for their own health and well-being.
14.2 RotYounges expects all employees and participants to comply with safety measures, such as wearing protective clothing or adhering to safety regulations on set.
14.3 In case of health problems or incidents, the responsible producer of RotYounges must be notified immediately.
Art. 15. Content of Projects and Creative Freedom
15.1 RotYounges retains creative freedom to develop, edit, and finalize the content of its projects.
15.2 The company reserves the right to make artistic decisions and introduce changes to the project, including modifications to scripts, production schedules, and other creative choices.
15.3 While feedback from involved parties is appreciated, RotYounges is not obligated to incorporate such feedback.
Art. 16. Intellectual Property of Employees and Freelancers
16.1 If employees or freelancers work on scripts, concepts, or other material for RotYounges, it is understood that RotYounges acquires exclusive rights to the final result of their work.
16.2 This means that RotYounges has the right to commercially exploit the work. This applies to material created during the collaboration as well as ideas that arise from the work for RotYounges.
Art. 17. Audio-Visual Recording
17.1 Everyone participating in a RotYounges production agrees to the recording and use of audiovisual material in which they may appear.
17.2 This material can be used for various purposes, including the promotion of RotYounges productions.
17.3 Any objections must be submitted in writing before the recordings take place.
Art. 18. Dispute Resolution
18.1 In the event of a dispute between RotYounges and another party, RotYounges will strive to resolve the conflict through negotiation or mediation.
18.2 If an amicable resolution cannot be reached, the dispute will be submitted to the competent court in the Netherlands, subject to Dutch law.
